On June 1, 2016, a new law went into effect requiring rental agencies to repair any safety defects open on their vehicles prior to renting them to customers, according to the National Highway Traffic Safety Administration (NHTSA). Fleets with more than 35 vehicles must remove vehicles with active recalls from their fleets until they are properly repaired.

For the first time, this law extends the NHTSA’s recall authority to rental companies, providing the agency with the power to investigate and punish violators.
The legislation was recently passed as a part of Congress’s Fixing America’s Surface Transportation (FAST) Act of 2015 and had strong support from NHTSA Administrator Dr. Mark Rosekind and U.S. Secretary of Transportation Anthony Foxx.
It also received support from the family of Raechel and Jacqueline Houck, two sisters who died in a rental car that had an open recall that had not been repaired.
Rosekind noted that rental agencies maintain some of the largest fleets in the country, which means this law will play a significant role in ensuring vehicles on the roads are safe.
With more than 900 recalls involving more than 51 million vehicles in 2014, Rosekind noted that it is critical that every vehicle on the road be repaired as soon as possible, regardless of if the vehicle is new, used, owned, leased or rented.
