Oklahoma Uninsured Motorist Coverage

According to the Insurance Research Council, in a number of states, nearly 25 percent of the drivers are uninsured. In Oklahoma, the compulsory liability insurance law states that every motorist on our roadways must meet the minimum insurance requirement to operate their vehicle, however this often proves to be untrue. The court explains that this Act is intended to protect the public using the highways from financial hardship which may result from the use of automobiles by financially irresponsible motorists.

As a result of these financially irresponsible drivers, there has been uninsured motorist coverage developed to provide compensation to the insured motorist for injuries and damages caused by another motorist, whom does not possess any form of liability insurance. According to Rogers v. Goad, 1987 OK 59,739 P.2d 519, 521, motorists covered are placed into either class one insured’s or class two insured’s, which can be described in the following:

Class One Insured’s

People included in this category are the named insured and the resident relatives in the household. This may include spouses or children that may have been driving the automobile at the time of the collision. Individuals falling in this category are entitled to the benefits of these policies where premiums have been paid.

Class two Insured’s

People included in this category are permissive users and other occupants of the insured automobile. Opposed to class one insured’s, people in this class are only entitled to coverage under the specific policy covering the vehicle at the time of the collision, and may not stack policies under which they have not been insured.

Simply put, class one insured’s are entitled to a wider variety of benefits than those of class two insured’s.
