Liability for a Tour Bus Crash
There are a number of reasons that people hire a tour bus. Depending on the circumstances of the crash, several parties could be held accountable for the accident. At times, there will be several parties listed on the contract for the tour bus, which in turn will effect who is held responsible for the damages.
The main role of the tour company is to organized all facets of the tour including, transportation, scheduling, accommodations and destinations. The company may or may not own the bus.
If the tour company owns the vehicle, they are responsible for making sure that the bus is maintained and meets all of the federal regulations. Also, they are required to hire driver that has a safe driving history. Now if the tour company has a contract with a bus company, the tour company is still responsible for hiring a bus company that has a good record.
The Bus Company
It is not out of the ordinary for the tour company to hire a bus company to provide the transportation for their various tours.
A bus company has some of the same responsibilities as the tour company, if they own the bus. The company must make sure that the bus is in good condition and has all of the licensing requirements.
Sometimes a destination will have an agreement with certain tour companies to provide a commission or a financial incentive to have the bus stop at their tourist attraction.
However, if the destination enters into an agreement that the tour bus stops there, they have the responsibility to make sure that the premises is safe for the bus to drive, park and maneuver around the location. If an accident occurs on the property because of some type of hazard, the destination will be held responsible for the losses incurred in the crash.
The Travel Group
The travel group refers to a group of passengers that contracts a tour bus or a group of acquaintances who have want to travel to the same locations.
The travel group could be held accountable for the collision, if they failed to exercise good judgment in regards to any other aspect of the trip, including the tour company, the bus company and the destinations; the travel group could be named as a defendant in a lawsuit.
